Terms and Use Agreement for All Associates and Clients of Virtual Sidekick, LLC.
The following constitutes a binding and legal Agreement of the use of services rendered by Virtual Sidekick, LLC. Breach of this Agreement will be considered infringement of Copyright and media protection laws, and willful breaking of site and company policies, and may result in termination of client or associate contract, as well as the initiation of legal action on behalf of Virtual Sidekick, LLC.
In the explanation of this Agreement, the term “the company” applies to Virtual Sidekick, LLC., all sub-companies and authorized company personnel. The terms “you” or “client” refer to any outside persons wishing to establish a client relationship with Virtual Sidekick, LLC., or any currently established client or associate.
Clients will agree to all terms set in this agreement. Failure to do so will result in the termination of client contracts and agreements without regard to refunds or services rendered.
As Related to Content and Censorship
The company reserves the right, on the basis of ownership, to present all graphics, logos, and websites created as portfolio samples or for the use of promotion only. The company may, at any time, feature certain websites or projects on the company’s website for the sole purpose of portfolio presentation or promotions. The company will make all attempts to notify the client in these instances. The featuring of a client website may result in advertising, marketing, and increased traffic to that client’s website. This is allowed by the company at no extra charge.
The company will, on the basis of service, provide such services as are advertised, mentioned, or stated on the website, in ads, newsletters or promotion media. Such services are provided to the general public, and are not determined by discriminatory factors such as race, gender, or disability of the client. The company does, however, reserve the right to lay ground rules for, set limitations on, or restrict the content put forth by the client on the basis of media censorship.
Clients will agree to run prospective web content by the company administrator before publication to the web. The client will not publish, or submit, content that is of an obscene nature, containing but not limited to profanity, nudity, prejudice, racism, or sexism, slander and/or images, or referring to the exploitation of persons, genders, or animals.
Client status may depend on certain factors related to federal and state laws. No person under the age of 18 may apply for client status without the expressed, written consent of a parent or guardian. The company reserves the right to confirm and verify any and all documentation related to the ages and identities of potential clients, or the parent/guardian submitted for approval of a client account. Currently, no persons with criminal backgrounds, or related to criminal activity, or in the sell and trade of illegal items or substances may apply for client status.
No persons involved in organizations related to terrorist, anti-government, or extremist activity may apply for client status.
As Related to E-Commerce and Legislation
No client may promote, distribute or sell, through means of websites created, any illegal items or substances, or use websites created by the company as a means of contacting and connecting with persons or organizations which promote, distribute or sell illegal items or substances.
No client may, through use of websites created by the company, create an organization or organizations intent on harm to other persons or animals,
All distribution plans and activities through sites created by the company must be submitted to an administrator for approval before the client associates or links the site(s) to that distribution, or before client uses the site(s) to promote or advertise said distribution.
As Related to Rights of the Company
The company will not discriminate unlawfully against persons seeking client status on the basis of race, religious affiliation, gender or disability. The company does, however, reserve the right to refuse client status of persons perceived to or known to be affiliated with factions or organizations related to crime and criminal activity, including the use and distribution of illegal items and substances.
The company reserves the right to verify age or any person seeking client status as related to federal and state laws regarding minors.
The company reserves the right to screen and limit content submitted by a client or person seeking client status on the basis of legal censorship.
The company reserves the rights to, at any time terminate the accounts, agreements, contracts and access of clients found in willful non-compliance of these terms and all policies set by the company.
As Related to Services Rendered
The company will not willfully promote, advertise or lay claims to services with are not within its power to provide. Services provided may come directly from the company, its sub-companies, or outside companies which have a working contract with the company. The company will make available information and links for services which it does not directly provide.
The client reserves the right to inspect and submit changes to content, graphics or logos created by the company.
The client may, upon inspection, be entitled to a full refund of money paid for services which do not please the client, or which were not created to the standards set forth by the client.
The client may, at any time, terminate his or her client status with the company, provided all terms of client contracts and agreements are met.
The company reserves the right to add, change or terminate products, services and packages containing group services so as to meet the needs of the company, and with or without prior notice to clients and associates.
